Process of Tourism Investment

A. Mode of Investment

If you intend to invest in the tourism industry and choose to invest especially in facilities for foreign travelers and ultimately benefit from the incentives provided by such investment, you will need to acquire the necessary licenses from the Ministry of Culture and Tourism. Hence, you need to decide which type of investment you want to make by taking the conditions of "The Code of Tourism Investment and Business Characteristics" (Turizm yatırım ve İşletmeleri Nitelikleri Yönetmeliği) into consideration.

B. Land

After deciding on the mode of investment, the land should be decided to make the investment. Three possibilities can happen here:

  • The land either belongs to the investor or will be bought by the investor.
  • The investor will benefit from the assignment of public domains inside the truism area and centers.
  • The investors will benefit from the assignment of public domains outside the truism area and centers.

The following procedure can be used for the above possibilities:

  1. The land either belongs to the investor or will be bought by the investor.

a) Construction plan of the land – In terms of the construction plan, the land's condition should be searched. This information concerning

i. Areas inside the borders of the municipality and adjacent area – can be acquired from municipalities

ii. Areas outside the borders of the municipality– can be acquired from provincial directorates for environment and urbanization (İl Çevre ve Şehircilik Müdürlüğü)

iii. 1/25.000 scaled plan of the whole land location - can be acquired from the Investment General Manager of the Ministry of Culture and Tourism.

b) 1/1.000 Scaled Plan - If development plans do not consider areas for tourism purposes, establishing tourism facilities will be forbidden. Therefore, there is a construction plan needed that will help to realization of tourism investment. Hence, you should seek whether there is a 1/1.000 scaled plan of the area. On this subject, the municipality will be visited for the areas inside the borders of the municipality and adjacent area. On the other hand, for the areas outside of the municipality, provincial directorates for environment and urbanization should be referred.

i. If a 1/1.000 scaled and approved plan has considered areas for tourism purposes where the land is located, tourism investment can be made. The area, the approved land for construction, the number of building floor, and height are taken from the construction plan, and the project starts.

ii. If a 1/1.000 scaled plan does not exist, the plan will be designed and approved by municipalities for areas inside the boards of the municipality and adjacent area and by provincial directorates for environment and urbanization for areas outside the municipality's borders. Next, the project starts in the above-mentioned lands.

C. Coastal Areas – According to the coastal laws, coast [edge] lines will be determined for coastal areas.

  1. Assignment of Public Domains Inside Truism Area and Centers

Assignment of the public lands in the tourism areas and centers to the investors, which are dedicated to tourism purposes and currently in possession of the Ministry of Culture from the respective public administrations, is deemed appropriate. Ministry of Couture specifies the last day of application and then announces the name of tourism investors through advertisements in official and daily newspapers.

In such a case, an application can be made with the necessary documents, as long as the conditions of "Regulation on Assignment of Public Land to Tourism Investments" (Kamu Arazisinin Turizm Yatırımlarına Tahsisi Hakkında Yönetmelik) are realized. A file containing all the data and documents mentioned in the specification issued by the Investment General Manager of the Ministry of Culture and Tourism should be sent to the Ministry of Culture and Tourism within 1 to 1.5 months after the advertisement in the newspaper. The application is answered within 2 months by the land assignment committee (arazi tahsis komisyonu). The decision of assignment will be finalized with the approval of the Ministry of Culture and Tourism.

  1. Assignment of Public Domains Outside Truism Area and Centers: Investor
  • Copy of a 1/25.000 scaled map of the required land, approved by provincial directorates for environment and urbanization,
  • A report in which the type of intended facility, category, capacity, and characteristics, infrastructural solutions, and any thought on marketing and management are stated,
  • And an application form containing personal information and the company

shall be presented to the Ministry of Culture and Tourism.

In terms of construction plans, this application will be reviewed, and if found favorable, the Ministry of Culture and Tourism will announce the land assignment.

C. Preliminary Permission and Tourism Investment License – At first, the above-mentioned investor will get a 6 (six) month clearance period. During this clearance period, the investor will require to get a "Tourism Investment License" as mentioned in "Regulation on Assignment of Public Land to Tourism Investments" to fulfill their commitments. Upon acquiring this license and fulfilling all the obligations, the land will be absolutely assigned, and then the investment process starts.

D. Start of Construction – Upon receiving an investment license, the construction activities can begin, but a construction license is required. Previously approved by local administrations and presented to the Ministry of Culture and Tourism, the architectural project, reinforced concrete static project, plumbing and electricity projects are the base of the investment license, and investment license can be acquired by referring to the same local administrations (municipalities for areas inside the boards of the municipality and adjacent area and provincial directorates for environment and urbanization for areas outside the municipality's borders).

No license fee will be paid if a tourism investment license is acquired from the Ministry of Culture and Tourism and an incentive certificate from the Ministry of Economy.

E.  Tourism Operation License - Upon acquiring a tourism investment license, an "occupancy permit" should be obtained from a local administration. An occupancy permit means that the Ministry of Culture and Tourism is informed the facility is ready to operate. It is reviewed whether the investment is made properly taking the project into consideration. If deemed suitable, a trial run will start. The trial run period is determined by the Ministry. After this step, the category of facilities with a suitable business/operation is determined based on the evaluation by the "categorization committee", formed by the General Manager of the Ministry of Culture and Tourism, and then the tourism operation license is given.
